KRAYN Site Intelligence — Terms of Service

1. Who we are and what these terms cover

These terms govern your use of KRAYN Site Intelligence — the property reporting service at krayn.au — provided by KRAYN Pty Ltd (ABN 95 696 422 009) ("KRAYN", "we"). By creating an account or purchasing a report you agree to these terms. These terms replace any earlier terms published on this site.

2. The service

Site Intelligence produces property reports for Australian addresses. A report resolves the legal parcel for an address, reads publicly available government datasets at that parcel, and presents findings, a verdict and supporting material weighted to the use you select (for example building, subdividing, investing or living). Reports state which checks ran at the address, which were not available, the government source of each finding, and known gaps or disagreements between sources. Report depth varies by state, territory and parcel because government data coverage varies.

3. What Site Intelligence is not

Site Intelligence is an information and decision-support tool. It is not: a valuation; a building or pest inspection; an engineering, geotechnical or environmental opinion; a planning approval or any indication one will be granted; a legal review of a contract; a planning certificate (such as a NSW s10.7 certificate) or a substitute for one; or a recommendation to buy, sell or not buy any property. Reports identify questions for qualified professionals — conveyancers, solicitors, engineers, certifiers, planners — and do not replace them. You must not rely on a report as the sole basis for entering a property transaction.

4. Data sources and accuracy

Findings are drawn from government and public datasets which KRAYN does not control. Those datasets may be incomplete, out of date, or wrong, and boundaries and classifications change. KRAYN reports what the datasets held at the time of generation, names the source of each finding, and declares gaps rather than concealing them — but to the extent permitted by law we do not warrant that any dataset is accurate, complete or current. Where a report states a check was "not available" at an address, no inference should be drawn that the matter is clear.

5. Accounts, plans and report allowances

Reports are sold individually or through plans. Subscription plans include a monthly report allowance; unused allowance does not roll over to the next month. Additional reports beyond an allowance may be offered in-app at the plan's stated per-report price. Multi-seat plans are for the named organisation; seats may not be shared outside it, and reports generated on an organisational plan may be used in the course of advising that organisation's own clients. Founding prices are promotional monthly prices for a limited number of early customers: a founding price holds for as long as that subscription remains continuously active; if the subscription is cancelled or lapses, current pricing applies on return.

6. Pricing and payment

Displayed prices are in Australian dollars and include GST. Payment is processed by Stripe; KRAYN does not store your card details. Subscriptions renew automatically monthly or annually until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access and your remaining allowance until then. A tax invoice is provided for each payment.

7. Refunds and consumer guarantees

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. In addition: if a report fails to generate, or is materially defective, we will regenerate it or refund the amount paid for it. We do not otherwise offer change-of-mind refunds on reports or subscription periods already begun.

8. Your use of reports

A report is licensed to you for your own decision-making (or, on organisational plans, for your organisation and its clients as described in section 5). You may share a report with your professional advisers and the other parties to the transaction it concerns. You may not resell reports as a standalone product, systematically extract their contents to build a competing dataset or service, or use automated means to bulk-generate reports outside your plan.

9. Third-party content in reports

Reports include mapping and aerial imagery and government data supplied under third-party licences (including Google Maps content used in accordance with Google's terms, and government open-data licences with attribution). That content remains its owners' property and carries its own terms. Attribution notices in reports must not be removed.

10. KAI (the assistant)

KAI answers questions using the product's own data and AI language technology. Its answers are general information, can be wrong, and carry the same limits as reports (section 3).

11. Liability

Nothing in this section limits the rights preserved by section 7. To the extent permitted by law, KRAYN's liability in connection with the service is limited, at our election, to resupplying the affected report or refunding the amount you paid for the affected report or subscription period; and KRAYN is not liable for decisions made in reliance on a report contrary to section 3, or for the accuracy of third-party datasets as described in section 4.

12. Changes, suspension and closure

We may update the service and these terms. We will give account holders at least 14 days' notice by email of material changes to these terms. We may suspend accounts for breach of section 8 and will state the reason. You may close your account at any time.

13. General

These terms are governed by the laws of Victoria, Australia, and disputes are subject to the courts of Victoria. If part of these terms is unenforceable, the rest stands. Personal information is handled as described in the KRAYN Privacy Policy. Contact: krayn@krayn.au.
