1. Acceptance of Terms
Welcome to KRAYN. By accessing or using our platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
2. Platform Description
KRAYN is an AI-powered heavy equipment rental marketplace connecting renters with suppliers across Australia. We facilitate transactions but are not a party to any rental agreement between users.
3. User Accounts
3.1 Registration
You must create an account to access certain features. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account and password.
4. Renter Responsibilities
As a renter, you agree to:
- Use equipment only for its intended purpose
- Operate equipment safely and according to manufacturer guidelines
- Maintain equipment in good condition during the rental period
- Return equipment in the same condition, normal wear excepted
- Pay all rental fees and charges in a timely manner
- Maintain appropriate insurance coverage
5. Supplier Responsibilities
As a supplier, you agree to:
- Provide accurate descriptions of equipment
- Ensure equipment is in safe, working condition
- Maintain appropriate insurance and certifications
- Honor confirmed bookings
- Respond promptly to rental requests
6. Payments and Fees
Zero commission on equipment hire transactions is KRAYN's permanent model. A service fee may apply to premium subscription features. All applicable fees are disclosed before booking confirmation.
7. Liability and Insurance
Users are responsible for obtaining appropriate insurance coverage. KRAYN is not liable for damages, injuries, or losses arising from equipment rental or use.
8. Limitation of Liability
To the maximum extent permitted by Australian law, KRAYN's liability for any claim arising from use of the platform is limited to the fees paid by the user in the 12 months preceding the claim, or $100 AUD, whichever is greater. KRAYN is not liable for indirect, consequential, or incidental damages. Nothing in these terms excludes or limits consumer guarantees under the Australian Consumer Law.
9. Dispute Resolution
Any disputes arising from use of KRAYN shall first be subject to good faith negotiation. If unresolved within 30 days, disputes shall be referred to mediation under the Australian Disputes Centre rules before any legal proceedings are commenced.
10. Intellectual Property
All platform content, AI models, algorithms, and technology remain the intellectual property of KRAYN Pty Ltd. Users retain ownership of their equipment listings and business data uploaded to the platform.
11. Force Majeure
KRAYN is not liable for failure to perform obligations due to circumstances beyond its reasonable control including natural disasters, government actions, telecommunications failures, or third-party service outages.
12. Warranties Disclaimer
The KRAYN platform is provided 'as is' without warranty of any kind, express or implied. AI-generated recommendations, valuations, site intelligence reports, and damage assessments are provided as guidance only and do not constitute professional advice. Users should obtain independent professional advice for significant decisions.
13. Cancellation and Refunds
Cancellation and refund policies for equipment bookings are set by individual suppliers. KRAYN facilitates communication of cancellation policies but is not a party to the rental agreement. Users should review supplier cancellation terms before confirming bookings.
14. Governing Law
These Terms are governed by the laws of Victoria, Australia.
